Why Do You Need a SAP?
A qualified Substance Abuse Professional (SAP) must evaluate DOT safety-sensitive employees who violate drug and alcohol regulations. The SAP assesses the employee’s situation and recommends treatment or education to ensure they are fit to return to work safely. This process is mandatory for reentry into safety-sensitive roles, supporting both compliance and employee recovery. Our SAP services are available in all 50 states and follow DOT and ODAPC guidelines.

The Return-to-Duty (RTD) process is a structured protocol by SAPs to ensure DOT safety-sensitive employees meet compliance and readiness standards before returning to work after a drug or alcohol violation. This structured process ensures compliance and confirms the employee's readiness to safely resume duties through a SAP follow-up evaluation after completing the required program.

As a reminder, DOT Rule 49 CFR Part 40 Section 40.289 states that employers are not required to provide a SAP evaluation or any recommended education or treatment for employees who have violated DOT drug and alcohol regulations. Payment responsibility for SAP evaluations and services lies between employers and employees, potentially influenced by labor agreements and healthcare benefits.
Before allowing an employee to return to a DOT safety-sensitive position after a violation, employers must ensure the employee has been evaluated by a Substance Abuse Professional (SAP) and has successfully completed all SAP-recommended steps.
